South Jordan Equipment Rental
Rental Terms and Conditions
Effective date: August 30, 2026
These Rental Terms and Conditions (the Terms) are between Maverick Ventures LLC, doing business as South Jordan Equipment Rental (the Company, we, us, or our) and the person or business identified on the rental agreement or checkout record (the Renter, you, or your).
The Company’s pickup location is 10901 S Jordan Gateway, South Jordan, Utah 84095. Pickup and return times are confirmed by phone or text.
1. Reservation requests and rental agreement
A reservation request is not an accepted rental and does not guarantee availability. A rental becomes binding only when the Company approves the request and the Renter accepts the final rental agreement, including the equipment, rental period, rates, deposit, and any additional charges.
The checkout record, equipment-condition photos, inspection checklist, approved reservation, invoices, and written messages related to the rental are part of the rental agreement.
2. Renter eligibility and identification
The Renter must be at least 18 years old, provide accurate contact and identification information on request, and be legally able to enter this agreement. The Company may decline or cancel a request before checkout when information cannot be verified, equipment is unavailable, or the Company reasonably believes the rental would be unsafe or unlawful.
Only the Renter and approved operators may use the equipment. The Renter is responsible for every approved operator’s compliance with these Terms.
3. Rental period, rates, and payment
The rental period begins when the equipment leaves the Company’s possession and ends when the Company receives the equipment back, performs the return inspection, and records the return. Rates, taxes, deposit, and payment timing are shown in the approved rental agreement or invoice.
The Renter must pay all rental charges, taxes, delivery or pickup charges (if any), and other agreed charges when due. The Company may require a refundable security deposit before checkout.
4. Pickup, inspection, and return
At checkout, the Renter will have a reasonable opportunity to inspect the equipment, confirm the included items, and report visible pre-existing damage. The Company may document condition with photos, video, and a checklist.
The Renter must return the equipment, all included items, and any accessories at the agreed time and location in the same condition received, ordinary wear and tear excepted. The Renter must promptly notify the Company if a return will be late. Continuing possession after the approved rental period does not create a new rental agreement.
5. Safe and lawful use
The Renter must use the equipment only for its intended purpose, in a safe and lawful manner, and according to manufacturer instructions, warning labels, and any Company instructions. The Renter must use appropriate protective equipment and obtain any training, permits, or site approvals required for the work.
The Renter must not:
- allow an unapproved, impaired, or unqualified person to operate the equipment;
- use the equipment for illegal purposes, racing, stunts, or operation in unsafe conditions;
- alter, repair, disable safety devices on, misuse, sublease, sell, or surrender possession of the equipment;
- remove identifying labels or allow the equipment to be taken outside the agreed service area without written approval; or
- use the equipment after discovering a problem that could make use unsafe.
6. Breakdowns, damage, loss, and theft
The Renter must stop using the equipment and notify the Company immediately if the equipment is damaged, stolen, lost, malfunctions, is involved in an accident, or creates a safety concern. The Renter must also promptly report theft to law enforcement and provide the Company the report number and cooperating information.
The Renter is responsible, to the extent permitted by law and as determined under the final rental agreement, for loss of or damage to the equipment and included items occurring during the rental period, except for damage caused solely by the Company’s failure to provide equipment in safe operating condition. The Company may charge reasonable repair, replacement, cleaning, recovery, and loss-of-use costs supported by the final rental agreement and applicable law.
7. Assumption of risk and release
Equipment use can involve serious injury, property damage, or death. The Renter understands those risks and voluntarily assumes the risks arising from use, transport, loading, unloading, possession, and operation of the equipment, except to the extent a claim is caused by the Company’s gross negligence or intentional misconduct or cannot legally be waived.
To the fullest extent permitted by law, the Renter releases and agrees to indemnify, defend, and hold harmless the Company, Maverick Ventures LLC, and their owners, employees, and agents from claims, losses, liabilities, damages, and reasonable expenses arising out of the Renter’s or any approved operator’s possession or use of the equipment, except to the extent caused by the Company’s gross negligence or intentional misconduct.
8. No warranties except as required by law
Except as expressly stated in writing and except where law does not allow a disclaimer, the equipment is rented as-is and the Company disclaims implied warranties, including merchantability and fitness for a particular purpose. The Renter confirms that the Renter selected the equipment based on the Renter’s own judgment.
9. Limitation of liability
To the fullest extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, delays, or loss of use, arising from the rental or equipment use. Nothing in these Terms limits liability that cannot legally be limited.
10. Default and recovery
If the Renter fails to return equipment when due, fails to pay amounts owed, provides materially false information, or breaches these Terms, the Company may take lawful steps to recover the equipment and amounts due. The Renter will cooperate with lawful recovery efforts.
11. Communications and electronic records
The Renter agrees that the Company may communicate by phone, text message, and email about reservations, pickup and return coordination, safety, invoices, and the rental agreement. Electronic records, approvals, photos, checklists, and signatures may be used to the extent permitted by law.
12. Governing law and venue
Utah law governs these Terms, without regard to conflict-of-law rules. Unless applicable law requires otherwise, any dispute will be brought in a court with proper jurisdiction in Salt Lake County, Utah.
13. General terms
If any provision is unenforceable, the remaining provisions remain effective to the fullest extent permitted by law. The Company’s failure to enforce a provision is not a waiver. These Terms, the approved reservation, checkout record, and any signed rental agreement are the complete agreement for the rental and replace prior discussions about that rental.
Acceptance
By signing the rental agreement, checking an acceptance box, or taking possession of equipment after receiving these Terms, the Renter acknowledges receipt of these Terms and agrees to them.
